Class actions

Bell Gully has extensive experience acting in class action proceedings, with our class action team recognised for its expertise in the New Zealand market.

We have acted in a number of significant class actions that have been before the New Zealand courts. For example, we currently act for ASX-listed company AWN Holdings and one of its directors in defending a class action concerning the initial public offering of listed education company Intueri Education Group Limited. We are also acting for 3A Composites, the manufacturer of Alucobond PE core cladding, in a building products class action.

Our experience also includes acting for the former directors of Feltex Carpets in defending the first modern securities class action in New Zealand, for ANZ Bank in a significant class action concerning bank fees, and for insurer Southern Response Earthquake Services in the first class action brought against an insurer in New Zealand.

Acting for ANZ Bank New Zealand Limited in defence of a class action brought by customers alleging errors in disclosing loan details.

Intueri class action
Defending a securities class action in the High Court against the promoters of an initial public offering of Intueri Education Group.

3A Composites GmbH
Defending the manufacturer of Alucobond cladding, in an attempted building products class action.

Southern Response class action
Successfully represented Southern Response in opposing an application by insureds for High Court approval to proceed as a representative class action. The customers alleged that Southern Response misrepresented its obligations under insurance policies, unreasonably delayed in processing and settling claims, and understated the true costs of rebuilds and repairs.
