He has extensive domestic and international experience in construction and projects.

Scott advises private and public clients in a variety of sectors, including renewable energy, infrastructure, health, transport, airports, water, manufacturing and industrial plants, telecommunications, and commercial developments.

He advises clients throughout the project lifecycle, with a focus on procurement strategy, tendering, contract drafting and negotiation, project advisory, and dispute avoidance.

Scott is experienced with all contractual models used in New Zealand from EPC contracting through to Alliancing. He advises on bespoke construction contracts, local and international standard forms (including FIDIC) and other ancillary project agreements required for the financing and development of major energy and infrastructure projects.

Scott previously worked for Freshfields in their construction and global major projects practice where he worked on projects throughout Asia, Africa and the Middle East. He was also seconded to clients, Marubeni Corporation in Japan and POSCO E&C in South Korea, where he advised on many international energy and infrastructure projects.

A previous edition of The Legal 500 Asia Pacific – Projects and Resources Management (including environment) recommends Scott as an up and coming lawyer in the market. Clients have said that “he has a proactive, collaborative style which brings deals together quickly.”

Work highlights

Genesis Energy
Advising Genesis Energy in relation to its 100MW/200MWh utility-scale battery energy storage system (BESS) at the Huntly Power Station, procurement of replacement generators for the Kaitawa hydro power station, and upgrade works to the sluice basin at the Rangipo hydro power station.

First Renewables (Clarus)
Advising First Renewables (Clarus) in relation to the 202MWp Tauhei solar farm in Te Aroha, Waikato, which is anticipated to be New Zealand’s largest solar farm, including the early works agreement, EPC contract, O&M contract, and related project agreements.

Lenders to Lightsource BP and Contact Energy
Advising the lenders comprising Westpac New Zealand, Mizuho Bank, China Construction Bank and Intesa Sanpaolo-IMICIB in relation to the 168MWdc Kōwhai Park solar farm in Christchurch, including the EPC contract, O&M contract, and related project agreements.

Health New Zealand
Advising Health New Zealand in relation to its Regional Hospital Redevelopment Programme, and the redevelopment of Whangarei Hospital which includes the design and construction of a new acute services ward, child health centre and ward tower.

Tauranga City Council
Advising Tauranga City Council in relation to the procurement of its Civic Precinct redevelopment project ‘Te Manawataki o Te Papa’, comprising a new library and community hub, civic whare, museum, exhibition gallery, together with landscaping of public spaces in the Tauranga CBD.

Auckland Transport
Advising Auckland Transport in relation to the Eastern Busway Alliance (EB2, EB3 and EB4) with non-owner participants comprising Fletchers, Acciona, Jacobs and AECOM, including drafting and negotiation of the Project Alliance Agreement and related utility works agreements with affected network utility operators along the busway route.

Metlifecare
Advising Metlifecare in relation to the construction of its Orion Point and Fairway Gardens retirement villages, and in relation to the drafting of a contract for the supply and installation of solar panels at development and operating villages.

Fletcher Building
Advising Fletcher Building on three separate large-scale brownfield projects involving the design and construction of new specialist processing plant factories, including the integration of specialist plant procured from overseas with domestic civil and vertical construction.

Runway Safe
Advising Runway Safe in relation to the drafting and negotiation of bespoke supply and installation contracts to deliver its engineered material arresting system at Queenstown International Airport and Wellington International Airport.

Tetra Pak
Advising Tetra Pak on the drafting of a bespoke equipment supply and installation agreement with Japanese food company, Meiji Group for the design, manufacture, supply, installation and commissioning of a skim milk evaporator and dryer at Meiji’s manufacturing facilities in Japan.

Visa
Advising Visa on its Auckland office refurbishment, including the drafting of a preconstruction services agreement and main works construction contract.
