A 2008 edition of legal journal Getting the Deal Through looks at private antitrust litigation across 27 worldwide jurisdictions and includes a chapter on New Zealand, authored by a Bell Gully partner and senior associates.
Partner Phil Taylor and senior associates David Blacktop and Simon Ladd outline the current legislation and explain how private anti-trust litigation has developed in New Zealand as the poor cousin to regulatory proceedings brought by the competition law regulator, the Commerce Commission.
They say that while current legislation provides for both regulatory and private action against parties engaged in anti-competitive conduct, comparatively few cases have been brought by private litigants. The chapter also explains New Zealand's private action procedure, class proceedings and available remedies.
