ANZ National Bank telecommunications outsourcing
Bell Gully advised ANZ National Bank on the renewal of its telecommunications outsourcing to Telecom New Zealand.

TelstraClear's settlement and broadband access
Bell Gully advised TelstraClear on an agreement with Telecom by which Telecom supplies TelstraClear with unbundled bitstream services on commercial terms and on an accelerated basis, in lieu of a regulated service prescribed by the Commerce Commission. The deal addresses numerous and complex issues related to the regulatory framework and Commerce Commission decisions.

Bell Gully has appeared for TelstraClear before the High Court in Wellington and the Court of Appeal on three separate regulatory-related disputes with Telecom.

In 2004, Telecom issued proceedings against the Commerce Commission and TelstraClear seeking declarations that various wholesale services were beyond the reach of the Commission's regulatory powers.

In August 2005, TelstraClear responded with a successful application to strike out Telecom's proceeding. In November 2005, Telecom issued judicial review proceedings against the Commerce Commission and TelstraClear in relation to the ongoing and high profile dispute over the regulation of unbundled bitstream services in New Zealand. Telecom sought interim orders preventing the Commission determining the terms on which that service must be supplied by Telecom to TelstraClear. TelstraClear responded with an application to strike out Telecom's proceeding. As a result Telecom discontinued its proceeding.

In February 2006, the Court of Appeal heard an appeal brought by Telecom against a 2005 judgment of the High Court in favour of TelstraClear which declared that the Commission has the power to backdate its determination of the price on which Telecom is required to supply regulated services to TelstraClear.

Telecommunications services outsourcing agreements
Bell Gully advised TelstraClear on two of the biggest telecommunications outsourcing deals seen in New Zealand in the past five years - agreements with Inland Revenue and Bank of New Zealand. They both included cutting-edge Voice Over IP solutions.

Master telecommunications agreement
Bell Gully advised TelstaClear on an agreement with Research and Education Advanced Network New Zealand for the first and only advanced network in New Zealand. The agreement came after a wait of 10 years by research and education users, such as Universities and Crown research institutes, for the adoption of such technology. This technically and legally complex deal saw TelstraClear mirror its network for a private network.
