Sales

A number of statutory regimes exist today which lay down rules of conduct for the sale of wine. The focus of sales law on consumer protection and consumer safety requires vigilance on the part of winemakers to ensure that adequate insurance cover is obtained and maintained (in the event that product safety is threatened) and that licensing requirements are complied with at all times.

Fair Trading Act 1986

The Fair Trading Act regulates conduct in trade, and prohibits misleading or deceptive conduct generally (section 9), conduct that is liable to mislead in relation to goods (section 10) and false or misleading representations as to the quality, grade, composition, style or nature of products (section 13).

Specifically, the Fair Trading Act regulates "representations" about food (which includes wine). A representation about wine is anything that sends a statement to consumers about that wine.
